Previous PCC decisions

The Professional Conduct Committee (PCC) is the disciplinary tribunal constituted under the Architects Act 1997 to hear allegations of unacceptable professional conduct and serious professional incompetence against architects.  These are the two “offences” under which an architect can be found guilty.  The Committee has the power to issue reprimands, levy fines, and suspend or erase an architect’s name from the Register.

Section 15(4) of the Act requires the PCC to publish the name and offence of those architects who have been found guilty of unacceptable professional conduct or serious professional incompetence.

The Act is silent on the length of time that an architect’s name and offence should remain in the public domain, but the Board’s view is that it is against the principles of natural justice for cases to be publicised indefinitely.  It has therefore adopted a policy whereby findings and penalties resulting from PCC hearings should be publicised for no more than the following periods:

Ultimately, however, the decision as to the period of publicity lies with the PCC.

The following tables contain a list of all cases heard by the PCC since 1997.  However, in line with the Board’s policy, the second table lists only the date, nature of offence and penalty imposed.  The name of the architect is withheld.

Nature of offence: UPC: (2) The Registered Person failed to keep the Complainant adequately informed of matters affecting the cost of their project. (3) The Registered Person failed to provide the Complainant with a copy of their written complaint’s procedure. And that by doing so, he acted in breach of namely Standards 6.1, 6.3, 9.2 and 10.2 of the Architects Code: Standards of Conduct and Practice 2017 (“the Code”).

Nature of offence: The Professional Conduct Committee (“the Committee”) determined that the Registered Person has been convicted of a criminal offence other than an offence which has no material relevance to her fitness to practise as an architect contrary to section 15(b) of the Architects Act 1997 (“the Act”) and is liable to a disciplinary order.
On 5 March 2024 the Registered Person was convicted at the Magistrates’ Court of Greffe Jersey, of the following offences:
Teresa Jane Blakeley between the 1 November 2021 and 11 October 2022, in the island of Jersey, with an attempt to obtain an award for herself furnished false information and documents regarding a tenancy agreement and payment of rent. Art 16 Income Support (Jersey) Law 2007.
Teresa Jane Blakeley between 11 October 2022 and 21st March 2023 in the island of Jersey, deliberately and falsely represented to the States of Jersey Customer and Local Services (CLS) that rent monies had been paid by way of deduction of monies owed by the Landlord in pursuance of a rental and renovations agreement with the Landlord, intending to cause gain to the said Teresa Jane Blakeley and prejudice to CLS, attempting to benefit to the sum of £5,740.59 which had been calculated as being overpaid. Common law.
and that by doing so, the Registered Person acted in breach of Standards 1.1 and 9.2 of the Architects Code: Standards of Conduct and Practice 2017.

Nature of offence: UPC: (1) The Registered Person failed to appropriately manage a conflict of interest; (3) The Registered Person failed to adequately supervise non-registered members of staff in relation to the contract administration of the project.By doing so, the Registered Person acted in breach of Standards 1.3, 3.4 and 6.3 of the Architects Code: Standards of Conduct and Practice 2017 (“the Code”).

Nature of offence: : UPC: The Registered Person: 1) Failed to provide adequate terms of engagement, contrary to Standard 4.4 of the Architects Code; 2) Failed to adequately and/or appropriately carry out his duties during the construction stage and/or as contract administrator in that he: a) failed to carry out adequate inspections of the project, b) failed to properly record site visits and meeting notes; 3) Sought to persuade the Referrers to enter into an agreement in which the terms: a) prevented them from submitting a complaint to ARB and/or his other professional bodies, b) and in attempting to do so, acted without integrity; 4) Failed to provide the Referrers with a copy of their written complaints procedure upon request; 6) Failed to communicate adequately with the Referrers; 7) Failed to adequately and/or appropriately carry out his duties as Principal Designer.

Nature of offence: : UPC. Melton Complaint 1. The Registered Person sent a letter dated 18 October 2018 in respect of Party Wall Matters to potential Adjoining Owner(s) in terms that: a) did not adequately explain that an Adjoining Owner may consent in writing to a notice and allow the works to continue without the need for surveyors to be appointed and an award to be made; b) did not adequately explain that an Adjoining Owner can consent to a Notice served on them without losing their rights under the Party Wall etc. Act; c) did not adequately explain that once appointed a Party Wall Surveyor’s Appointment cannot be rescinded. 2.The Registered Person sent a letter dated 30 October 2018 to the Building Owner in which he said he had been appointed by both Adjoining Owners when this was not the case.
Eagleston Complaint 1.The Registered Person did not provide any and/ or any adequate written terms of engagement to his client in respect of b) Phase 2 of the Project.
Savage Complaint 1.The Registered Person failed to provide his client with adequate terms of engagement.

(1) He has been convicted of a criminal offence other than an offence which has no material relevance to his fitness to practice as an architect, in that he was convicted on 11 January 2024 of: [Offence 1] Between 09/05/2019 and 12/06/2019, at an address, distributed an indecent photograph, namely, a Category A moving image of a child, contrary to sections 1(1)(b) and 6 of the Protection of Children Act 1978; [Offence 2] Between 09/05/2019 and 12/06/2019, at an address, distributed an indecent photograph, namely, a Category B Moving image of a child, contrary to sections 1(1)(b) and 6 of the Protection of Children Act 1978; [Offence 3] On or before the 21/03/2023 at an address, made indecent photographs, namely 39 Category A Moving Images of children, contrary to sections 1(1)(a) and 6 of the Protection of Children Act 1978; [Offence 4] On 21/03/23, at an address, made indecent photographs, namely, 7 Category B images of children, of which 2 are moving images, contrary to sections 1(1)(a) and 6 of the Protection of Children Act 1978 and [Offence 5] on or before 21/03/23, at an address, were in possession of 74 prohibited images of children of which 2 were moving images, contrary to sections 62(1) and 66(2) of the Coroners and Justice Act 2009.

Nature of offence: (1) Unacceptable Professional Conduct (“UPC”) in relation to Property A.  The particulars of the Charge are that the Registered Person: (i) Failed to provide Referrer A with adequate terms of engagement contrary to Standard 4 of The Architect’s Code; (ii) Failed to adequately define her role as project manager for the construction stage of the project; (iii) Allowed work to commence on site without the appropriate approvals; (iv) Failed to identify defective work on site during her inspections; (v) Failed to disclose the conflict of interest which arose during the project in accordance with Standard 1.3 of The Architect’s Code. (2) The Registered Person’s actions in respect of 1(vii) above (i) were dishonest, (3) Unacceptable Professional Conduct (“UPC”) in relation to Property B.  The particulars of the Charge are that the Registered Person; (i) Failed to provide Referrer B with adequate terms of engagement contrary to Standard 4 of The Architects Code; (ii) Failed to ensure that variations to the initial written agreement were recorded in writing contrary to Standard 4 of The Architects Code; (iii)  Issued inadequate drawings and information for construction purposes; (iv) Allowed works to commence on site without the appropriate approvals; (v) Failed to identify key structural elements on site which were missing; (vi) Failed to identify defective works on site during her inspections; (vii) Received payment from the contractor during the construction stage without disclosing this to the client; (4) The Registered Person’s actions at 3(iv) were (a) dishonest, (5) The Registered Person’s actions at 3(vii) were (a) dishonest.

Nature of offence: (1) The Architect failed to provide their client with adequate written terms of engagement contrary to Standard 4.4 of the Architects Code. (2) The Architect failed to adequately advise the client on costs, in that he: i) Did not provide adequate advice on the initial construction costs for the project;  ii) Did not provide the client with an adequate method of tracking costs against the original budget as the project progressed; (3) The Architect failed to manage a conflict of interest adequately in that he: i) Failed to disclose to the client in writing that by acting as both architect and contractor his advice would not be impartial; and ii) Failed to obtain written consent from the client that he should continue to act in the circumstances; (4) The Architect failed to act with due skill and care in his role as Architect and/or Contract Administrator in that he: i) Failed to advise the client, adequately or at all, of their duties under the CDM Regulations 2015; ii) Failed to prepare and/or ensure the Health and Safety Information was put in place before work started on site; iii) Failed to notify the client in a timely manner of the requirement to pay the Community Infrastructure Levy payment; iv) Failed to adequately advise the client on the merits of using a standard building contract; v) Failed to issue interim payment certificates in a timely manner and/or at all;  vi) Failed to provide a complete set of working drawings for the construction phase of the project; vii) Failed to adequately discharge planning consent pre-conditions on the project; (5) The Architect failed to safeguard the client’s money, in that he failed to obtain the client’s consent in relation to three payments totalling £15,000 to an intermediary broker; (6) The Architect failed to ensure the construction was carried out in compliance with Planning and/or Building Regulations requirements; (8) The Architect’s actions at particulars 3 and 5 lacked integrity; (9) The Architect’s actions at particular 5 were dishonest.

Nature of offence: (1) He has been convicted of a criminal offence other than an offence which has no material relevance to his fitness to practise as an architect, in that he was convicted on 9 August 2022 of: (i) Arson, contrary to Criminal Damage Act 1971; (ii) Possess a Weapon for the discharge of a noxious liquid/gas/electrical incapacitation device/thing, contrary to Firearms Act 1968; (iii) Intimidate witness in Civil Proceedings, contrary to Criminal Justice and Police Act 2001; and (iv) Possess a Weapon for the discharge of a noxious liquid/gas/ electrical incapacitation device/thing, Contrary to Firearms Act 1968.

Nature of offence: (1) The Registered Person issued a Professional Consultants Certificate dated 26 May 2014 stating that he had inspected the property from commencement of the construction to completion, when in fact: (1b) he first inspected the property upon completion in 2009. (2) The Registered Person issued a Professional Consultants Certificate dated 18 November 2016 stating that he had inspected the property from commencement of the construction to completion, when in fact: (2b) he first inspected the property upon completion in 2009. The Registered Person’s actions at particular 1 (b) and 2(b), (a) Were misleading; (b) Lacked integrity; and (c) Were dishonest.
